How North Carolina Classifies DWLR Charges

North Carolina General Statute 20-28 generally classifies Driving While License Revoked as a Class 3 misdemeanor. Driving While License Revoked for an impaired-driving revocation is a separate offense under the same statute. It’s generally classified as a Class 1 misdemeanor and can result in an additional revocation upon conviction.

The basis and timing of the revocation, as well as eligibility for reinstatement, may affect how the offense is handled. A conviction for a moving violation committed during a suspension or revocation can also trigger another revocation period under North Carolina General Statute 20-28.1. The potential consequences depend on the specific charge, the driver’s history, and the status of the underlying revocation.

Related Charges Aren’t Interchangeable

People often use “suspended license” and “revoked license” to describe the same problem, but the legal charge depends on the person’s license status and charging document. No Operators License generally concerns driving without a valid license, rather than driving during an active revocation. An impaired-driving revocation also creates a more serious category than an ordinary revocation.

The Reason for the Revocation Shapes the Response

A legal strategy begins with identifying why the license was revoked. Common causes include failure to appear in court, failure to pay court obligations, accumulated driving points, an impaired-driving matter, or another motor-vehicle violation. Addressing the new criminal charge doesn’t automatically resolve the separate administrative or court issue.
